Article 1 - Definitions
- HardcoverDiscounter: The company that offers printing services via hardcoverdiscounter.com
- Customer: The natural person or legal entity entering into an agreement with HardcoverDiscounter
- Order: The customer's request to HardcoverDiscounter to deliver products
- Product: The printed matter to be delivered by HardcoverDiscounter
- Agreement: The agreement between HardcoverDiscounter and the customer
Article 2 - Applicability
- These general terms and conditions apply to all offers, orders and agreements of HardcoverDiscounter.
- By placing an order, the customer accepts these general terms and conditions.
- Deviations from these terms are only valid if agreed in writing.
Article 3 - Offers and prices
- All prices on the website are in euros and include VAT, unless otherwise stated.
- Shipping costs are calculated separately and shown during the ordering process.
- HardcoverDiscounter reserves the right to change prices. Placed orders are executed at the price that applied at the time of ordering.
- Obvious errors in prices do not bind HardcoverDiscounter.
Article 4 - Order and agreement
- An agreement is concluded when the customer places an order and payment has been received.
- HardcoverDiscounter confirms the order by email.
- The customer is responsible for the correctness of the provided data and files.
- HardcoverDiscounter reserves the right to refuse orders or set additional conditions.
Article 5 - File delivery
- The customer is responsible for delivering print-ready files according to HardcoverDiscounter's specifications.
- Files must be of sufficient quality for the desired end result.
- HardcoverDiscounter is not liable for quality loss due to unsuitable delivered files.
- The customer guarantees that the delivered files do not infringe on the rights of third parties.
Article 6 - Delivery
- Delivery times are indicative and not strict deadlines.
- Delivery is made to the address specified by the customer.
- The risk of the product passes to the customer upon delivery.
- In case of non-collection or refusal of the product, the costs remain at the customer's expense.
Article 7 - Payment
- Payment is made in advance via the offered payment methods.
- The order is only put into production after receipt of full payment.
- In case of late payment, the customer is automatically in default.
Article 8 - Right of withdrawal
- Because HardcoverDiscounter's products are made to order according to the customer's specifications, the right of withdrawal is excluded in accordance with article 6:230p sub f BW.
- This means that orders cannot be cancelled or returned after production has started.
Article 9 - Complaints and warranty
- Complaints about delivered products must be reported in writing within 14 days of receipt.
- HardcoverDiscounter offers a warranty on production errors. See our quality guarantee page for details.
- Color deviations within the usual tolerances of the printing process do not constitute grounds for complaints.
- In case of justified complaints, HardcoverDiscounter will reproduce the product free of charge or refund the purchase amount.
Article 10 - Liability
- HardcoverDiscounter's liability is limited to the amount of the relevant order.
- HardcoverDiscounter is not liable for indirect damage, consequential damage or lost profits.
- HardcoverDiscounter is not liable for damage caused by incorrectly delivered files or data.
Article 11 - Intellectual property
- The customer retains all rights to the delivered files.
- The customer indemnifies HardcoverDiscounter against claims from third parties regarding intellectual property rights.
- HardcoverDiscounter may only use delivered files for the execution of the order.
Article 12 - Privacy
HardcoverDiscounter processes personal data in accordance with the General Data Protection Regulation (GDPR). See our privacy statement for more information.
Article 13 - Force majeure
- In case of force majeure, HardcoverDiscounter is not obliged to fulfill its obligations.
- Force majeure means: any circumstance beyond HardcoverDiscounter's will that temporarily or permanently prevents fulfillment.
Article 14 - Applicable law and disputes
- Dutch law applies to all agreements.
- Disputes are submitted to the competent court in the district where HardcoverDiscounter is established.
Article 15 - Changes
HardcoverDiscounter reserves the right to change these terms and conditions. The most current version is always available on this page.
